Competition rules Vavato – World Cup 2022 competition

 

Article 1: The Organiser

Vavato BV, Waaslandlaan 14, 9160 Lokeren, Belgium, and with company number BE 0599.890.164 organizes a competition “World Cup Competition” (hereinafter referred to as the “Competition”).

Article 2: Duration of the competition

The competition runs from Sunday 20/11/2022 (00h01) and ends on Sunday 18/12/2022 (23h59).

Article 3: Conditions

The competition is open to any person over the age of 16 (on the date of the competition) residing in Belgium, excluding the Organiser’s staff, as well as any entity directly or indirectly involved in the design, the organization, realization and/or management of the competition.
The Organiser reserves the right to exclude an entrant from the competition and/or not to award the prize and/or to cancel the entrant’s entire participation, without assuming the Organiser’s liability, in any breach by the entrant of these rules and/or if the Organiser believes in its sole discretion that the entrant has acted or intends to act dishonestly, deceptively or in bad faith. In particular, but without limitation, any use of robots or any system, device or act that is fraudulent, dishonest or bad faith, or any conduct, including without limitation, causing automatic play of the match and/or the chances of to be increased is prohibited. The Organiser may file a complaint and/or have the perpetrators of such conduct prosecuted. In the event of sanctions or complaints, participants must prove that they have acted in accordance with these Rules. Participants may be invited at any time to prove their identity, place of residence and age. Part of the competition consists of placing an online bid on the auction platform http://www.vavato.com.
The respective participation in this specific competition is accompanied by a possible purchase obligation if the placed bid is also the highest bid at the end of the auction, as described in section 5.1.

Article 4: Prizes

4.1 Description of the competition prizes

To be won for the entire duration of the competition: a total of 11 prizes.

  • 10 x duo tickets for an exclusive meet & greet with Jan Vertonghen. This meet & greet will take place at Vavato’s head office (Waaslandlaan 14, 9160 Lokeren, Belgium). With a value of 1,000 euros incl. VAT together with an emotional value due to the unique experience.
  • An official Red Devils World Cup shirt, worn during one of the matches played and signed by the entire team. The unsigned t-shirt has a value of 89.95 euros incl. VAT.

4.2 Prizes details

The value of the prize is determined on the date of preparation of these Regulations and cannot be contested. Prizes are non-transferable, may not be substituted for another prize and no cash alternative is available. The Organiser reserves the right to substitute the announced prize with a prize of comparable value and characteristics, should such substitution prove necessary.

Article 5: Announcement of the winners and presentation of the prizes

5.1 To participate in the competition, the participant must take the following steps:

  • The participant must place an online bid on the auction platform www.vavato.com for the duration of the competition.
  • Go to https://blog.vavato.com/world cup-2022/
  • Subsequently, the participant must fill in the contact details:
    • First name
    • Name
    • Email – This must be the same email address associated with the MyVavato account so that verification can be done with the online bids.
    • Accept:
      • Contest Rules
      • Contact in the context of this competition
  • Waiting for the participant to be informed whether he/she has won or lost.

5.2 Determination of the winners:

During the competition, the participants must place an online bid on one of the auctions on the auction platform http://www.vavato.com.

Correctly answering the tiebreaker question (winners are determined based on the contestant closest to the true value).

If several participants in the same time slot both have the correct answer to the tiebreaker question and have answered equally quickly, there is a tie. The participant who enters the time slot first will be declared the winner of the competition.

The number of winning opportunities is limited. Participants who enter several times using the same personal details can only win once. The Organiser therefore reserves the right to designate the next winner from the list of entries as the effective winner in this case. And so on, until a winner has been found who wins at most for the first time.

The competition results will be announced 22/12/2022 at the latest. The Organiser reserves the right to deviate from this.

The winners will be contacted and informed by email and receive the prizes:

  • Live
  • Or by post

The meet & greet with Jan Vertonghen, at which the World Cup shirt will also be handed over, will be scheduled based on Jan Vertonghen’s schedule. The Organiser states that this will take place at the end of February 2023 or the beginning of March 2023 and reserves the right to deviate from this. The winners will be notified in due time of the specific date and time.

Article 6: Regulations

Participation in the competition implies full acceptance of these rules. No response will be given to requests made by email or telephone regarding the interpretation or application of the rules governing the terms and conditions of the competition. The rules will be available at https://blog.vavato.com/world-cup-2022-contest-rules/ for the duration of the contest. These regulations can also be obtained until 18/12/2022 upon simple written request to: Vavato – Marketing Department, Waaslandlaan 14, 9160 Lokeren, Belgium. Postal costs for this request will not be refunded. For all elements of the competition not expressly mentioned in these regulations, the Organiser reserves the right to take all necessary measures for the proper organization of the competition. The Organiser reserves the right to change these rules when it deems it necessary.

Article 7: Participation costs

Participation in the competition is free, with the exception of the costs incurred by the participant to possibly purchase the lottery ticket if the participant also placed the highest bid, the Internet or postal services carried by the participant himself.

Article 8: Limitation of Liability

8.1 The Organiser cannot be held responsible for problems inherent to the internet connection, telephone communication or any other problem which cannot be attributed to the Organiser and which may occur during the duration of the competition. The Organiser makes every effort to provide and maintain functional and verified infrastructure, information and resources for entrants. However, the Organiser cannot be held responsible for the failure of the participants’ equipment (computer, software, internet connection tools, telephone, servers, etc.), the loss of data as a result that is not attributable to the organizing company and the impact of these failures on their participation in the competition. It is therefore up to each participant to take all appropriate measures to protect its equipment and the data stored on its equipment (computer and telephone) against breaches. Participation in the competition implies in particular the knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy by third parties and the risk of contamination by possible viruses circulating on the Internet.

8.2 Entrants accept that the data contained in the Organiser’s information systems has evidential value until proven otherwise, with regard to the connecting elements and information resulting from a computer action related to the competition.

8.3 The Organiser undertakes to use all available resources from its service providers to ensure the proper functioning of the competition. However, should a technical failure occur and affect the proper functioning of the competition due to circumstances beyond the control of the Organiser, the latter cannot be held liable by the participants.

8.4 If a winner’s details are unusable or if the winner cannot be identified, it is not the Organiser’s responsibility to carry out further investigations to find the winner, who will receive neither their prize nor any compensation or damages.

8.5 Winners will be contacted by email. The winner will then have 14 days from the date of the e-mail notifying him of his winnings to reply to this e-mail with the requested information and thus indicate acceptance of the prize.

8.6 In the event of an express waiver of the prize by the winner, this prize will be returned to the Organiser and may be used for a subsequent promotion, if the nature of the prize allows and without any liability on the part of the Organiser.

8.7 This competition is in no way sponsored, endorsed or administered by or associated with Facebook/Twitter/Instagram or any other social media channels. By entering the Contest, each entrant agrees to release Facebook/Twitter/Instagram and all their respective officers, directors, employees, representatives and agents from any and all liability, damage, loss or injury arising in whole or in part, directly or indirectly from the resulting from entrant’s participation in the competition and the acceptance, use or misuse of any prize they may win.

8.8 The competition may be affected by mandatory efforts to contain the spread of COVID19. The Organiser therefore reserves the right to – suspend / cancel the competition in part or in full – substitute or cancel any particular prize if the Organization deems it necessary due to restrictions imposed by local authorities or any requirement related to COVID19. Winners may be required to take a COVID 19 test, if required. Winners must comply with all measures related to COVID19.

Article 9: Contact

Non-conforming correspondence (incomplete, illegible, incorrect, prepaid, delayed or not sent) will not be taken into account.

Article 10: Disqualification

Entrants allow all verifications regarding their identity, age and address as part of the Contest. Any entry that does not comply with these regulations, is incomplete or with incorrect coordinates will be considered void. The use of robots or any other similar method to play the game mechanically or otherwise is prohibited, violation of this rule will result in the eventual elimination of the participant and/or user. The Organiser may cancel the competition in whole or in part if it appears that fraud has taken place in any form, through the computer or the fact of participation under the identity of a third party and/or the determination of the winners. In this case, the Organiser reserves the right not to award prizes to fraudsters and/or to bring the perpetrators of this fraud before the competent courts.

Article 11: Force majeure

The Organiser is not liable in case of force majeure or events beyond its control or if circumstances require it, it is obliged to cancel, shorten, extend, postpone, suspend or change the conditions of the current competition. In any case, the Organiser reserves the right to extend the participation period.

Article 12: Exemption from liability

The winners are fully responsible for the use of their prize. The Organiser cannot be held liable for any defects or problems with the prizes or for any incident or accident that may occur to the winners during or because of the use or possession of the prize.

Article 13: Authorization to use the names and addresses of the winners

Subject to obtaining the express consent of the main entrant, the Organiser may use the name and address of the winners for advertising purposes without entitling them to compensation or transferring any other benefit. This permission is requested in writing via e-mail. If the participant agrees by email, this is regarded as explicit consent.

Article 14: Intellectual property rights and copyrights

In accordance with intellectual property rights and copyright laws, the use of all or any part of the copyrighted material contained in this contest is strictly prohibited, except with the prior express consent of the Organiser.

Article 15: Applicable law and disputes

The competition is subject to Belgian law (Belgium). Any dispute regarding the interpretation of the rules and/or cases not covered by these regulations will be the subject of an amicable settlement. Otherwise, the exclusive jurisdiction of the courts of Antwerp (Belgium).

Article 16: Protection of personal data

The Organiser acts in accordance with the applicable data protection regulations. The Organiser uses entrants’ personal data to enable them to participate in the competition and to contact them if they have won a prize. The information collected by the Organiser is only collected for the purpose of identifying the winner(s). This data will be kept for the duration of the competition (described in Article 2) and the additional period during which the winners are awarded their prizes (described in Article 5.1.). This with a maximum extension until 31/12/2023. Afterwards, this data will be permanently deleted.
